Administrative law
Appeals against tacit refusal
When the administration does not reply within the period set by the Code of Administrative Procedure, its failure to rule is treated as a tacit refusal, which can be appealed in its own right. I prepare the appeal against the tacit refusal to the competent court; the time limits for challenging it run from the expiry of the period for ruling, not from receipt of a reply, and meeting them in time is decisive for the success of the case.
