INHERITANCE LAW LAWYER IN PLOVDIV

Inheritance law

Lawyer Miroslav Mirchev is an inheritance law lawyer in Plovdiv. He advises and represents heirs, testators and co-owners of inherited property in the acceptance and renunciation of an inheritance, the drafting and contesting of wills, the protection of the reserved share, the determination of inheritance shares and partition, including where the heirs or the property are abroad.

Inheritance law governs what happens to a person’s property after their death: who inherits it, in what shares, how it can be disposed of by will and which heirs the law protects with a reserved share. Most problems arise from missed time limits for acceptance or renunciation, unclear or contestable wills and disputes between heirs, which is why timely legal advice prevents costlier disputes later.

These services are sought by heirs, testators, heirs abroad and co-owners of property. The most common questions concern the acceptance and renunciation of an inheritance, wills, the reserved share, inheritance shares and partition.

Frequently Asked Questions

What happens to the property if there is no will?
The property is inherited by law: first the descendants (children, grandchildren) inherit together with the spouse and, in the absence of descendants, the parents, siblings, the spouse and other relatives in the order laid down by law. If there is no heir at all, the inheritance passes to the state.
How is an inheritance accepted, and can I renounce it?
An inheritance is accepted by a written declaration, by conduct or by inventory. Renunciation of an inheritance is declared before the district court.
Am I liable for the debts of the deceased?
Yes, the heir is liable for the obligations of the deceased, but where the inheritance is accepted by inventory, liability is limited to the value of the inherited property. Before accepting the inheritance, therefore, check the obligations as well.
What types of wills are there, and which is the most secure?
The most commonly used are the holographic will (written entirely, dated and signed by the testator) and the notarial will. The notarial will is the most secure because its form is checked by a notary and it is harder to contest.
What is a reserved share, and can it be infringed?
The law protects the closest heirs (children, parents, spouse) with a reserved share, which the testator cannot dispose of. If a will or a gift infringes it, the heir may seek a reduction of the disposition through the courts within the statutory period.
Can a will be contested?
Yes, through the courts, for example where the form was not observed, where the testator lacked the capacity to make a will, or in the case of fraud or duress. The time limits are short, so it is important to act quickly.
How is inherited property divided when the heirs cannot agree?
Where a voluntary partition is not possible, any co-owner may request a judicial partition. The proceedings take place in two phases: first the court establishes who the co-owners are and what their shares are, and then it carries out the actual distribution: by allotting physical shares, by drawing lots or by putting the property up for public auction if it cannot be physically divided.
